Foql Creator Payment Terms

These terms govern how creators are paid on Foql and are part of the Terms of Service.
1. Roles
Foql operates a marketplace and, through its payment processor ([Stripe, Inc.] and its Connect program), facilitates payments from brands to creators. Foql is not a bank, money transmitter, or escrow agent. Funds paid by brands are held by the processor in accounts controlled by Foql for the purpose of settling transactions on the Service. Amounts are not yours until they are "Available" in your wallet as described below.
2. What you earn
- Contest (casting) payouts: the fixed, published amount per selected winner for the tier (currently $40 Starter / $45 Studio / $75 Pro), plus any required-post amount ($80 Story / $160 Reel) and any add-on amounts stated in the casting. Identical for every creator; not negotiable within a casting.
- Direct bookings and guaranteed invites: your list price for the pack, in full. Foql's platform fee is charged to the brand on top.
- Posts (add-on): your posted rate, in full, plus any whitelisting uplift you set. Foql's fee is charged to the brand on top.
- Kill fees: 50% of the license price if a brand cancels a guaranteed invite or direct booking after your approval; 25% of your post fee if a brand cancels a post after you accept.
- No-selection payment: $5 if you were shortlisted in a casting the brand allowed to expire.
- Renewals: 50% of the original payout if a brand renews a license.
3. When you're paid
- Pending — recorded when the triggering event occurs (license issued; post live; kill fee triggered).
- Available — 7 days after Pending, provided no dispute, chargeback, or report is open on the underlying transaction.
- Paid — transferred to your connected payout account on the weekly schedule (every [Friday]), or on request via Instant Payout (processor fee shown at request; currently [1%] min [$0.50]). Post fees release 50% when the post is verified live and 50% after the minimum live period (24 hours for Stories, 30 days for Reels/TikToks). Payment timing may vary by bank; Foql is not responsible for processor or bank delays.
4. Holds, reversals, and adjustments
Foql may delay, hold, or reverse amounts that are Pending or Available if: the brand's payment fails or is charged back; a report, dispute, or verification issue is open on the transaction; a post is removed before its minimum period (forfeits the second tranche); a license is revoked for your breach; we suspect fraud, duplicate accounts, or policy violations; or law requires it. Amounts already Paid will not be clawed back except for fraud, duplicate payment, or as required by law; where a chargeback occurs after payment, Foql absorbs it unless it results from your breach.
5. Taxes and status
You are an independent contractor. You are responsible for all taxes on amounts you earn. We (or our processor) will collect tax information (for example, Form W-9) and issue tax forms (for example, Form 1099) where required. Payouts may be suspended until required tax information is provided. Foql does not withhold taxes unless legally required.
6. Payout account
Payouts go only to a payout account in your legal name that you verify through our processor. You must keep it current. We cannot pay to third parties, cash, or crypto. Currency is USD. You are responsible for any fees your bank charges.
7. No guarantee of earnings
Foql makes no promise about the number of castings, invites, selections, posts, or earnings you will receive. Earnings depend on brand demand, fit, and your choices.
8. Disputes about amounts
Contact payments@foql.com within 60 days of the transaction. We will review ledger records, which are the authoritative record of amounts owed. Our determination is final for platform-level payment disputes, subject to your rights under the Terms of Service dispute-resolution section.
9. Liability
To the fullest extent permitted by law, Foql's total liability to you for payment-related claims is limited to the amount properly owed to you and unpaid. Foql is not liable for processor errors, bank delays, currency changes, tax consequences, or losses from incorrect payout details you provided. Nothing in these terms limits liability that cannot be limited by law.
10. Changes
We may change payout amounts and fees for future work with 30 days' notice; changes never apply to castings you entered, invites you accepted, or posts you accepted before the change.
